After a bitter battle to get it through parliament France's new three strike
internet piracy law or Hadopi as it is known finally came into effect today. Web users that download films, music, games and other copyrighted material illegally will first be sent a warning email from their internet service provider warning them to stop. If they continue to download copyrighted material they will then be sent a letter and for further offences will be taken to court where the judge can fine them or suspend their internet access.
The French government has struggled to get the new legislation passed with many of its opponents saying that the new law is far too draconian. French senator Michel Thiolliere said that "The internet is a fabulous world, but it needs rules, if you want to get cinema, music or video games in the future."

... Logic says protection is the proper way. But perhaps these old established industries need to adapt to the changing world, rather than rely on their old style technologies. Once the genie has been let out of the bottle, while you can try force, you cannot keep it in ... and piracy will come - if not from here then from China, India and other areas where out rules count for nothing. Copying will always exist, we cannot stop that, and probably should not. Seen negatively, the new rules will encourage people to find new ways around them. The authorities will find they are fighting a losing battle. Seen positively, an open approach to copying etc could force old style companies and technologies to change and adapt to meet their new challenges creatively. I wonder how the theatre reacted when film came along, and many old style forms of entertainment dies away. And don't forget that the music industry was quick to use this technology when it worked to their advantage and greater profits ... and still does when it comes to enhancing poor singers or developing flashy videos to promote their services. How many old style bands and styles of music have been lost because of the modern music machine, that now says it needs protection unless it is to follow the same fate? |
